Terms of Service

1. Purpose
These Terms of Service (the "Terms") govern the relationship between Pinny (the "App") and you (the "User") in connection with the travel planning and recording services (the "Service") provided by the App. By accessing or using the Service, you agree to be bound by these Terms. These Terms are governed by the laws of the Commonwealth of Australia, including the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law ("ACL") set out in Schedule 2 of that Act, and the Electronic Transactions Act 1999 (Cth).
2. Definitions
- "Service" means all services provided by the App, including trip itinerary management, map-based recording, checklists, budget management, AI-powered itinerary recommendations, sharing and collaboration features, and any additional services developed from time to time.
- "User" means any person who agrees to these Terms and uses the Service.
- "Content" means all information created, uploaded or shared by a User within the Service, including trip itineraries, photographs, journal entries, budget records and any other data.
- "ACL" means the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
3. Changes to the Terms
- These Terms take effect when the User accepts them.
- The App may amend these Terms from time to time to the extent permitted by applicable law. Any amendment will be notified to Users via in-app notice at least 7 days before the changes take effect.
- If you do not agree to the amended Terms, you may discontinue using the Service and delete your account.
- Continued use of the Service after the effective date of an amendment constitutes acceptance of the amended Terms.
4. Account Registration
- Users may register an account via social login (Apple, Google or Kakao).
- Users must provide accurate information and must not use another person's identity or credentials.
- Users are responsible for maintaining the security of their account. If you become aware of any unauthorised use, you must notify us immediately.
- The Service is not available to persons under 15 years of age. By registering, you represent that you are at least 15 years old.
5. Services Provided
- The App provides the following services:
- Trip itinerary creation and management
- Map-based travel recording and route display
- Checklists and budget management
- AI-powered itinerary recommendations
- Trip sharing and collaboration features
- Other services developed and released by the App from time to time
- The Service is generally available 24 hours a day, 7 days a week. However, the Service may be temporarily interrupted for system maintenance, updates or circumstances beyond our reasonable control.
6. Advertising
- The App may display advertisements to support the operation of the Service.
- Any transaction arising from an advertisement is solely between the User and the advertiser. The App is not a party to such transactions and accepts no liability in connection with them, except to the extent that liability cannot be excluded under the ACL.
7. User Obligations
Users must not:
- Misappropriate or fraudulently use another person's personal information;
- Use the Service for any purpose that is unlawful or contrary to public order or accepted standards of morality;
- Interfere with or disrupt the operation of the Service;
- Post or transmit obscene, violent or otherwise objectionable content through the Service;
- Threaten the security of the Service or exploit any vulnerabilities;
- Use the Service for unauthorised commercial purposes; or
- Engage in any other conduct that contravenes applicable Australian law.
8. Content Rights
- Intellectual property rights in Content created by a User remain vested in that User.
- By using the Service, you grant the App a non-exclusive, royalty-free, worldwide licence to store, display and transmit your Content solely for the purpose of providing the Service.
- The App will not use your Content for any purpose other than providing and improving the Service.
- Where a User sets Content to "public" or "shared", other authorised Users may view that Content.
9. Service Restrictions
- The App may restrict access to the Service or suspend a User's account if the User breaches these Terms.
- Where access is restricted, the App will notify the User of the reason for the restriction.
- A User may lodge an objection by contacting us at the address below.
10. Account Deletion
- Users may delete their account at any time through the in-app settings.
- Upon account deletion, all User data (trip itineraries, photographs, journal entries, budget records, etc.) will be permanently deleted.
- Deleted data cannot be recovered.
11. Limitation of Liability
- Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the ACL or any other applicable law that cannot be excluded, restricted or modified by agreement.
- Subject to clause 11.1, the App is not liable for any failure to provide the Service caused by force majeure events, including natural disasters, war, civil unrest, pandemic, government action or internet infrastructure failure.
- Subject to clause 11.1, the App is not liable for any loss or damage arising from the User's own negligence, misuse or failure to maintain account security.
- The App does not guarantee the accuracy, completeness or reliability of information obtained through the Service, including AI-generated recommendations. Such information is provided for general guidance only and does not constitute professional advice.
- To the maximum extent permitted by law, the App's total aggregate liability to you for any claim arising out of or in connection with these Terms or the Service is limited to AUD $100.
12. Dispute Resolution
- These Terms are governed by the laws of the State of New South Wales and the Commonwealth of Australia.
- In the event of a dispute arising out of or in connection with these Terms, the parties agree to first attempt to resolve the dispute through good-faith mediation before commencing court proceedings.
- If the dispute is not resolved within 30 days of a party notifying the other of the dispute, either party may commence proceedings in the courts of New South Wales, Australia, which shall have non-exclusive jurisdiction.
- Nothing in this clause prevents a User from making a complaint to a relevant consumer protection authority, including the Australian Competition and Consumer Commission (ACCC).
13. General
- Any matters not addressed by these Terms shall be determined in accordance with applicable Australian law and accepted practice.
- If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- The App's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
- These Terms constitute the entire agreement between the User and the App in relation to the Service and supersede all prior representations, agreements and understandings.
